Terms of Service

These Terms govern your use of Trade Studio ("the Software"), provided by Jasper Kilian Moore, Am Weberholz 11, 41469 Neuss, Germany, moorejasper060@gmail.com ("we", "us"). By applying for the beta, creating an account, installing, or using the Software you accept these Terms. If you do not accept them, do not use the Software.

1. What Trade Studio is

Trade Studio is software you run on your own computer. It may connect to your own brokerage or crypto-exchange account using credentials that stay on your machine. Availability varies by provider, jurisdiction, and beta support level. You decide whether to run a bot, in paper or—only after a separate confirmation—live mode, and you control its settings.

• We do not receive, hold, or have access to your money, your securities, or your brokerage credentials.
• We do not execute trades for you, manage your account, or make personalized investment recommendations.
• The local Software may place orders automatically according to visible declarative rules, only while you have enabled it. The cloud services have no order endpoint or broker authority.

Trade Studio is a tool, not financial, investment, tax, or legal advice. Nothing it does or displays is a recommendation to buy or sell any security.

2. Eligibility & your responsibilities

You must be of legal age and legally permitted to trade in your jurisdiction. You are solely responsible for:

• opening and funding your own brokerage or crypto-exchange account and complying with that provider's terms (some brokers and exchanges restrict availability in your country);
• every order the Software places on your account while enabled, and for monitoring it;
• the settings you choose (symbols, risk, leverage, mode);
• all taxes arising from your trading; and
• complying with the laws that apply to you.

3. Closed beta, paper mode, and live promotion

• The current closed beta is invite/approval based, has plan and usage limits, and is provided without public checkout or subscription billing.
• Every AI-created bot must validate locally, complete an exact-rule backtest, and begin in paper mode.
• Live mode trades real money on your real account.
• Live promotion is a separate manual action, subject to beta availability, entitlement, broker support, credentials, and an explicit risk confirmation. Expired access blocks new entries/configuration while local protective exits remain available where technically possible.
• Any future paid offer will have separate pricing, renewal, cancellation, and withdrawal information before a charge is accepted.

4. Trading risk — read this

• Trading involves substantial risk, including the total loss of your capital.
• Broker margin, shorting, derivatives, or leverage can cause losses beyond cash deposited. Availability and exposure are controlled by your broker account and the settings you choose; do not assume a displayed limit overrides broker rules.
• Crypto and forex carry additional risk. Crypto assets are highly volatile, trade 24/7, and can lose most or all of their value very quickly; forex and other margin products can move sharply against you. Availability and asset classes depend on the broker or exchange you connect and your jurisdiction.
• Markets are unpredictable. Software can contain bugs, and can place, miss, or mistime orders. Connectivity, broker, exchange, data-feed, or operating-system failures can cause losses.
• No profit is promised or guaranteed. Any simulated, historical, or illustrative performance is not a prediction of future results.
• You should not trade with money you cannot afford to lose.

5. No warranty

The Software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that it will be uninterrupted, error-free, profitable, or that it will meet your requirements.

6. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any trading losses or for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software. Our total aggregate liability for direct damages is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

Mandatory-law carve-out (Germany/EU): Nothing in these Terms limits liability that cannot be limited by law — including liability for intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, under the Product Liability Act (Produkthaftungsgesetz), or under any other mandatory statutory liability. For slight negligence we are liable only for breach of an essential contractual obligation (Kardinalpflicht), and then only for foreseeable, contract-typical damage.

7. Acceptable use

Do not share beta access or protected installers, attack or bypass service limits, upload credentials or another person's data, resell/redistribute the Software, or use it unlawfully or to manipulate markets. We may suspend beta access for security, abuse, or breach of these Terms; the action is audited.

8. Changes, governing law, contact

We may update these Terms; material changes will be posted on this page. These Terms are governed by the laws of Germany, without prejudice to the mandatory consumer-protection rights of your country of residence.
